Smith grew up in Clay, a suburb of Syracuse in New York. In 1987, he earned his high school diploma from Liverpool.

He received his Juris Doctor from Harvard Law School in 1994 after receiving his Bachelor of Arts summa cum laude from the State University of New York, Oneonta. Following graduation, he worked as an Assistant District Attorney in the Sex Crimes and Domestic Violence Units of the New York County District Attorney’s office.

Smith started working as an assistant US attorney in the Middle District of Tennessee in 2015.

After David Rivera’s resignation in March 2017, he took over as acting US Attorney until Donald Q. Cochran’s nomination took effect in September. In 2017, Smith was appointed vice president and director of litigation at Hospital Corporation of America.

Smith was appointed to a four-year term as the chief prosecutor for the Kosovo Specialist Chambers at The Hague on May 7, 2018, with responsibility for looking into war crimes committed during the Kosovo War, including the case of Salih Mustafa.

On September 11, 2018, he was appointed to the position, and on May 8, 2022, he was given a second term.
